§1. General Provisions

The website at selectbaubedarf.com is operated by SELECT Baubedarf und Handelsgesellschaft mbH Austria, 5020 Salzburg, Warwitzstraße 9 Businesscenter SAM, Email: trade@selectbaubedarf.com. In this agreement, SELECT Baubedarf und Handelsgesellschaft mbH is referred to as "SELECT", "us", "we", "our website", and "site". The website selectbaubedarf.com is subject to the conditions outlined in this document. These Terms of Use (TERMS AND CONDITIONS) constitute a legal agreement between you and us. Deviating terms and conditions of the customer are non-binding unless they have been expressly acknowledged by us in writing. If you do not agree to the terms of this agreement, you are requested to refrain from using the website selectbaubedarf.com.

The customer acknowledges that the use of the services on the website selectbaubedarf.com indicates the customer's willingness to accept the Terms and Conditions of Sale as updated from time to time and to be bound by them. The seller reserves the right to change the Terms and Conditions of Sale from time to time, without such change affecting an order already placed by the customer. Any changes and/or new conditions will take effect upon their publication on the website. For this reason, the seller asks customers to regularly access the website and check for the publication of updated Terms and Conditions.

The Terms and Conditions of Sale do not govern the provision of services or the sale of products by third parties who may be linked to SELECT through links, banners, or other hypertext links. We recommend that you review the terms and conditions of such third parties before placing orders and purchasing products or services from them, as the seller is under no circumstances responsible for the provision of services or commerce transactions by third parties. If you use our site on behalf of a legal entity, organization, or company, you represent and warrant that you are authorized to bind that entity to these terms. The Commission provides a platform for out-of-court dispute resolution (OS platform), which can be accessed at https://ec.europa.eu/consumers/odr.

§2. Registration and Customer Account

You may need to register with us to use certain aspects of our service. To register, the buyer must complete the registration form and provide their first and last name, email address, and a password. Registration is confirmed via an email sent to the address provided by the buyer. You agree that the information you provide to us is accurate and that you will keep it accurate and up-to-date at all times. You are solely responsible for maintaining the confidentiality of your account and password. You are responsible for all activities that occur under your account. If you have reason to believe that your account is no longer secure, you must notify us immediately at trade@selectbaubedarf.com.

§3. How to Conclude a Contract with the Seller

• Send a request for a quote via the product page, wishlist, brand page, contact form, or email to trade@selectbaubedarf.com.
• Receive a quote from the seller by email.
• Confirm the quote by replying via email or through the Contact Form.
• Receive an Invoice for your order by email.
• Make payment according to the Invoice.
• The Invoice includes a summary of your order: recipient and buyer details, key product features, pricing, payment method, shipping cost, and production time.
• Order status "Paid" / "In Production": Once payment is received, the order is forwarded to the manufacturer.
• Order status "Ready to Ship" / "Shipped": The order is completed by the manufacturer and dispatched to your address.

§4. Product Prices

The website displays the manufacturer's recommended price, excluding shipping costs and VAT.

§5. Products Marked as «@Request a Quote»

The recipient's country/location affects product availability and delivery costs:

• Please provide the recipient's address as completely as possible.
• For corporate customers, please include full company details.

Send us a «@Request a Quote» via the product page, wishlist, brand page, contact form, or by email to trade@selectbaubedarf.com.

If prices for these products are available in our system, you will receive a quote in your inbox within 24 hours.

In some cases, we may need 2–3 business days to clarify product costs with the manufacturer. We will then email you the quote.

§6 Payment

All business transactions carried out via the website selectbaubedarf.com are concluded between you and SELECT Baubedarf und Handelsgesellschaft m.b.H. By using our services, you (the user) expressly agree to all terms and policies of this website. This agreement is entered into between us and you (the user).

To prevent unauthorized access to your data, the order and payment process is encrypted using the hybrid encryption protocol for secure data transmission "Secure Sockets Layer" (SSL) (https).

Once you confirm your order, you will be redirected to a reliable online payment provider according to the selected payment method and connected to a secure online payment system. Credit card data is protected and used only by the secure online payment provider Payment Services. The NEXI e-commerce online payment system complies with important security standards such as SSL and PCI DSS (Data Encryption Standard DES and Payment Card Industry Data Security Standard required by credit card companies).

Possible transfer fees and bank charges are the responsibility of the customer.

Refunds for returns will be made to the bank account from which the original order was paid.

§7. Warranties

A manufacturer’s warranty applies to all products sold via SELECT. Although SELECT does not itself provide a warranty for the products we sell, we support you in resolving problems during the warranty period. If you have issues with a product purchased from us with a manufacturer’s warranty, please contact our customer service. We will either assist you with a solution or establish contact with the manufacturer, who can help you directly.

If a product sold by the seller has manufacturing defects, you must immediately contact our customer service by email via our contact page.

If you wish to have the product repaired or replaced under this §, the seller will cover the cost of returning the product to be repaired or replaced, as well as the cost of delivering the repaired or replaced product to you.

All products are delivered in their original packaging. Do not damage the original packaging of the purchased products.

§8. Shipping

Shipping Cost

We offer the best carrier rates with no extra fees — based on FedEx, DHL, or freight shipping prices. Self-collection is also available.

Shipping costs are borne by the customer and are listed on the Order and Invoice, unless otherwise stated.

Orders are delivered safely and reliably using top-tier shipping companies, with all shipments insured for the full value of the products. Fragile items are shipped with special packaging for extra protection.

Depending on the type of product, our team will determine the most suitable shipping method to ensure your order arrives in perfect condition.

Standard Shipping – Small Parcels

Small packages are shipped via FedEx or DHL.

Once the package is picked up by the courier, you will receive a tracking link to monitor the status of your shipment.

Most items shipped via FedEx or DHL can be delivered without a signature.

If you require a signature, please leave a note in the comment field when placing your order.

The delivery date is not scheduled in advance. The parcel will be delivered to your doorstep.

Delivery attempts are made 2–3 times on working days only.

Standard Shipping – Large Items

Large items are shipped via the most suitable carrier.

Unless otherwise agreed, delivery will be made to the curbside in front of your home.

Unlike FedEx or DHL services, tracking links may vary depending on the carrier used.

The shipping company will contact the customer by phone or email to arrange delivery.

Disposal of packaging and pallets is the customer’s responsibility.

Special Delivery Service

A special delivery service with indoor delivery and assembly is available upon request.

Your item will be delivered to the room of your choice, unpacked, assembled, and the packaging removed.

The shipping company will contact you by phone or email to schedule a specific delivery time.

§9. VAT for EU Countries

• Private customers: 20% VAT (19% for Germany) is added to the manufacturer's price.
• Business customers with a valid EU VAT number: No VAT is charged.

§10. INTERNATIONAL DELIVERY - TAXES AND IMPORT CHARGES

USA, Australia, UK, Canada, Switzerland, Norway, and other Non-EU countries:

As soon as the goods arrive at the destination, taxes, customs duties, and handling charges are determined by the respective customs authority.

Please note that we have no control over these charges.

FedEx, DHL, other shipping companies, or customs agents assist the recipient with the formalities of paying local VAT, import taxes, and handling fees in your country. For information about duties and taxes in your destination country, please contact your local customs office.

You must comply with all applicable laws and regulations of the country for which the products are intended. We are not liable or responsible if you breach any such laws.

You are fully responsible for paying all applicable import charges directly to the relevant authority (and for reclaiming them in the event of cancellation or return of the products, where permitted by these Terms and Conditions), as determined by the authorities at the delivery location. Neither SELECT nor its logistics partners assume any responsibility or liability in this regard.

The seller’s shipping partners may contract with a customs broker authorized at the destination. Your agreement to these Terms and Conditions serves as authorization for the respective customs broker to act as your representative to: (A.) conduct transactions with the local authority, (B.) complete, submit, and sign the appropriate documents on your behalf related to the import of the products in your order, (C.) facilitate the payment of applicable import charges, and (D.) if applicable, return the product to us (subject to these Terms and Conditions).

However, in the event of a return of products, you (and not the seller, the logistics partners, or anyone on their behalf) bear full responsibility for reclaiming such import charges from the relevant tax authority, where possible. Neither the logistics partner nor the seller accepts any responsibility or liability in this regard.

If you fail to pay taxes or import duties without valid reason, thereby causing liability to SELECT, its logistics partners, or the carrier, you must reimburse us and/or the involved third parties for the amount. We reserve the right to offset these charges against any refunds or other amounts claimed by you.

If you fail to pay taxes, import duties, or refuse acceptance of the products in a way not aligned with the return procedure outlined in these Terms and Conditions (including failure to provide documents requested by customs), and the products are returned or must be returned, you will be held liable for the cost of return shipping.

If the return shipping costs are disproportionate to the value of the returned product, the seller reserves the right not to retrieve the product and to have it destroyed. In such cases, a refund of the purchase price is not possible.

We also reserve the right to charge you for any additional direct or indirect costs arising from this failure or refusal.

§11. Return and Refund

If you are not satisfied with the product you purchased from us, you may exercise your 14-day right of withdrawal.

In this case, you will receive a full refund of the product price in accordance with this §.

To receive a refund, the product must be returned in new, uninstalled condition and in the original packaging.

The withdrawal period begins on the day you or a third party named by you took possession of the goods.

Return Processing – Return Authorization:

Please contact us via "Contact" on our website or by email at trade@selectbaubedarf.com and send us a clear declaration of withdrawal from the purchase contract including your order number via email.

Once your return request has been approved, you will receive a return authorization by email and our customer service will initiate the return.

Packing and Returning the Product(s):

Make sure the products are securely packed. Please do not write on the original packaging.

You are required to return the products within 14 days from the date of the withdrawal notice using a shipping company of your choice and at your own expense. The costs and risks associated with returning the products are the customer’s responsibility. You are obliged to inform us of the tracking number.

After the return has been received, we need approximately fourteen (14) days to inspect the condition of the product(s), although it may take longer in individual cases.

Once the condition "new, uninstalled, and in the original packaging" is confirmed, you will then receive a full refund of the purchase price. The buyer must cover any loss in value of the goods, i.e., if the goods have lost their original condition.

We will use the same payment method for this refund that you used for the original transaction, unless otherwise agreed.

Alternatively, we can assist you with the return of the products using a prepaid method and a courier selected by us (a fee will be charged for this service). Please contact us via "Contact" on our website or by email at trade@selectbaubedarf.com.

Exceptions:

Many of the items sold on SELECT are made to order after you place your order.

No returns or exchanges will be accepted on the following items, exceptions are indicated on product page or Order or Invoice. For example, sales of the following items are considered final:

- Products that have already been installed or assembled.

- Products clearly marked on the order confirmation or proforma invoice or invoice as «Made to Order items» or «Customized items».

We reserve the right to grant a refund in the form of store credit under certain circumstances.

§12. Transport Damage and Complaints

If you receive a damaged product, you have the option to refuse delivery and/or document any damage to the product on the delivery note. Please notify us of the identified damages via the contact form or by email at trade@selectbaubedarf.com so that we can return or exchange the goods.

What to do if the damage is not immediately noticed at the time of delivery?

In this case, we kindly ask you to email us digital photos of the damage and document individual damages to the product, including your invoice number. This would enable us to file a damage report with our insurance company. We therefore ask for your cooperation. If you do not send us digital photos of the damage by email and do not document any damage to the product, we cannot file a claim with our insurance company and cannot accept any liability for the damage.

We kindly ask that you report the receipt of the damaged product to our customer service within 48 hours and keep the packaging. If the damage report is not submitted in time, we cannot make any claims to our insurance company and the assertion of damage claims is excluded in this case. Usually, the damaged product will be picked up by the carrier. We kindly ask you to prepare the shipment for return in an appropriate manner on the scheduled date and time.

We will review the claim within 7 to 10 business days. If the complaint is accepted, we will send you a replacement part or exchange the defective goods as soon as possible, at no additional cost to you.

selectbaubedarf is not liable for reimbursement of labor costs or project delays that may arise due to receiving damaged goods. We strongly recommend that you wait to begin scheduled project work until your product has arrived and its condition has been inspected.

§13. Defective Products

Products with factory defects or missing parts

Please contact us if you discover a product defect.

Please understand that our technical support team or the manufacturer's representatives may request additional information from you in order to precisely identify the problem.

Replacement products will be shipped free of charge, and we will cover all shipping and return costs. The relevant instructions will be provided to you. We ask that you retain the defective product until you receive the necessary instructions from selectbaubedarf.com.

No claims for defects exist in the case of only minor deviations from the agreed condition.

Rights and claims due to defects in used goods are generally excluded.

The limitation period does not apply if a replacement delivery is made under liability for defects.

You are obliged to inspect the goods for any quality and quantity discrepancies and inform us of any defects by email to trade@selectbaubedarf.com within 2 days (private customer) or 7 days (business customer) after receipt of the goods. The notice is considered timely in any case if it reaches us within the specified period.

This also applies if hidden defects are discovered at a later date (after unpacking). Warranty claims cannot be made if the inspection obligation and the duty to notify defects are not fulfilled.

In the event of a defect, we provide a warranty either by repair or replacement at our discretion. If the defect rectification fails twice, you may request a reduction in price or withdraw from the contract.

No claims can be made against selectbaubedarf.com for reimbursement of labor costs or project delays that may arise due to receipt of defective products.

§14. Events Beyond Our Control

We are not liable or responsible for any failure to perform or delay in the performance of any of our contractual obligations that is caused by an act or event beyond our control, such as floods, communication network or system failures, storms, embargoes, war, acts of war (whether war is formally declared or not), strikes, lockouts, civil unrest and labor disputes, force majeure, delays by authorities or another third party. Our obligations under the contract are suspended and the time for fulfilling our obligations is extended for the duration of the event beyond our control. If the event beyond our control affects our delivery of products to you, we will agree a new delivery date with you once the event has passed.

§15. Intellectual Property Rights

All content on selectbaubedarf.com, including but not limited to texts, photos, videos, images, documents, drawings, logos, and any other material in any format, is protected by copyright and other intellectual property rights, which belong to the seller and other rights holders. The reproduction, modification, duplication, copying, distribution, sale, or any use of the images and content of the website is strictly prohibited unless previously authorized in writing by SELECT Baubedarf und Handelsges.m.b.H.

§16. Infringement of Intellectual Property

We respect the intellectual property rights of others.

your address, telephone number, and email address;

a statement by you that the above information in your notice is accurate and that you are the copyright or intellectual property owner or authorized to act on behalf of the copyright or intellectual property owner under penalty of perjury.

§17. Our Liability

Nothing in these Terms and Conditions limits or excludes our liability for:

- death or personal injury caused by our negligence;

- fraud or fraudulent misrepresentation; or

- any other liability that cannot be limited or excluded by law.

Our total liability to you for all losses arising out of or in connection with the contract with you shall under no circumstances exceed the price of the products.

§18. Product Presentation

We offer products only from established and selected manufacturers.

The key features of the products are displayed on each product page on selectbaubedarf.com.

While SELECT Baubedarf strives to include accurate information and descriptions (including prices, images, specifications, and availability) of products on the site, it does not guarantee that this information is accurate, complete, reliable, current, or error-free. SELECT Baubedarf reserves the right, but is not obligated, to change, correct, or update product information available on the site at any time at its sole discretion without prior notice.

If you receive a product that is not as described on the site, your sole and exclusive remedy is to return the unused product as permitted under these terms.

§19. Changes and Updates

The Terms and Conditions may be amended from time to time due to new laws and regulations or for other reasons. The new Terms and Conditions come into effect on the date of their publication on artemest.com and therefore apply to orders placed after that date.

§20. Consent to Electronic Communication

By using the service, you agree to receive certain electronic communications from us. You agree that all communications, agreements, disclosures, or other communications we send you electronically satisfy any legal requirement that such communications be in writing.

§21. Governing Law, Place of Performance, Jurisdiction

All legal disputes arising from or in connection with the purchase contract shall be governed exclusively by Austrian law.

For users, this choice of law applies only to the extent that the protection granted by mandatory provisions of the law of the country in which the user has their habitual residence is not withdrawn (principle of favorability).

If the user is a merchant, a legal entity under public law, or a special fund under public law, our place of business shall be the exclusive place of jurisdiction for all disputes arising from this contract, as well as the place of performance for all services provided by us in the context of existing business relationships. The same place of jurisdiction applies if the customer has no general place of jurisdiction in Austria or the EU, or if their residence or habitual place of abode is unknown at the time the action is filed.

The provisions of the UN Convention on Contracts for the International Sale of Goods do not apply and are expressly excluded.

If any provision of these Terms and Conditions is invalid, the validity of the remaining provisions shall not be affected.
